Bentley Authors Lead Article for the Stetson Law Review on the Florida Land Use and Environmental Dispute Resolution Act
Mark Bentley, of Mark Bentley, PA in Tampa, recently authored “Understanding the Florida Land Use and Environmental Dispute Resolution Act.” Mark’s article was published as the lead article in the 2008 Stetson Law Review – Local Government Symposium.
The Act provides landowners with the opportunity to invoke an informal, accelerated proceeding that mediates disputes with the government regarding laws, rules, regulations, or ordinances that unfairly burden real property.
Mark has participated in many proceedings under the Act as both a special magistrate and as counsel for property owners. As a result of his experiences, Mark is able to identify some of the Act’s shortcomings and ambiguities, and he recommends several amendments that may not only increase its use as an alternative dispute resolution process, but also increase its effectiveness.
Mark is certified as an expert by The Florida Bar in City, County and Local Government Law, and has an established law practice focusing on the areas of property rights, land use, and eminent domain.
